2.25em;">本案中，张某与陈某两次发生争吵，陈某在第二次争吵中倒地失去意识，当日经抢救无效死亡的事实客观存在。但是，在争吵过程中，张某与陈某并无身体接触，其本身不具有侵害乙生命健康权的主观意图，客观上亦未实施具体的伤害行为，陈某作为已满72岁的老人，明知自己患有高血压且年事已高，本应对自身的生命安全负有高于常人的谨慎注意义务，但其未能管理好自己的情绪，自身未尽到安全注意义务，致情绪激动引发自身疾病发作，是导致其死亡最主要的原因。</p><p style="outline: 0px;text-indent: 2.25em;">张某在面对年事已高的陈某时，未能采用更为合理、冷静的方式处理双方纠纷，未尽到审慎注意义务，对陈某损害后果的发生存在一定过错，应当对陈某的死亡承担部分损害赔偿责任。宣威市人民法院判决综合考虑事情起因经过、双方过错程度、因果关系及死者自身身体状况等实际情况，判决张某承担10%的赔偿责任，由张某赔偿陈某近亲属人民币4万余元。</p><p style="outline:
